Introduction

After an extended, but abstract, discussion of the case of a woman whose husband has gone abroad and has purportedly not left her with provisions, the Talmud tries to determine what the actual halakhah is in this situation.

 

מאי הוה עלה? כי אתא רב דימי אמר: מעשה בא לפני רבי בבית שערים, ופסק לה מזונות, לפני רבי ישמעאל בצפורי, ולא פסק לה מזונות;

 

What did they decide about this?  When R. Dimi came he said: Such a case came in front of Rabbi at Beth She’arim and he made an allowance for her maintenance, and in front of R. Yishmael at Tzippori and he did not make an allowance for her maintenance.

 

We can see here that Rabbi Judah Hanasi said that she does receive maintenance, whereas R. Yishmael said that she does not.

 

תהי בה רבי יוחנן, וכי מה ראה רבי ישמעאל שלא פסק לה מזונות? הא לא נחלקו בני כהנים גדולים וחנן אלא לענין שבועה, אבל מזוני יהבינן לה!

 

Yohanan was astonished at this decision: What did R. Yishmael see that caused him to not give her maintenance? Behold the sons of the High Priests and Hanan disputed only on the question of the oath, but [they all agree that] they give her maintenance?

 

Yohanan raises a difficulty on R. Yishmael—in the mishnah all parties agree that she receives maintenance! They only argue over the oath that she must take that she did not take more than she was supposed to receive.

 

א”ל רב שמן בר אבא, כבר תרגמה רבינו שמואל בבבל: כששמעו בו שמת, א”ל: פתריתו בה כולי האי.

 

Shemen b. Abba answered him: Our Master, Shmuel, in Babylon has already solved: [She receives maintenance only] when they have heard that he died. He responded, “With this, you have solved everything?”

 

Shemen gives the same resolution we have seen over and over that was originally issued by Shmuel. She receives maintenance only if the court has heard that the husband died. R. Yohanan seems to remain skeptical of this answer.

 

כי אתא רבין אמר: מעשה בא לפני רבי בבית שערים, ולא פסק לה מזונות, לפני רבי ישמעאל בציפורי, ופסק לה מזונות; א”ר יוחנן: מה ראה רבי שלא פסק לה? דהא לא נחלקו חנן ובני כהנים גדולים אלא לענין שבועה, אבל מזונות יהבינן לה! אמר ליה רב שמן בר אבא, כבר תרגמה שמואל בבבל: כששמעו בו שמת, אמר ליה: פתריתו בה כולי האי.

 

When Rabin came he related: Such a case came in front of Rabbi at Beth She’arim and he did not grant the woman maintenance, and in front of R. Yishmael at Tzipori and he made an allowance for her maintenance. R. Yohanan said: What reason could Rabbi see for not granting her an allowance! Behold Hanan and the sons of the High Priests disagreed only about the oath  but [they agreed that] they give her maintenance? R. Shemen b. Abba answered him: Our Master, Shmuel, in Babylon has already solved: [She receives maintenance only] when they have heard that he died. He responded, “With this, you have solved everything?”

 

This is a slightly different version of the same material we saw before. The only real difference is that the positions of Rabbi and R. Yishmael have been reversed.
